According to the new rules, a WFOE (Wholly Foreign Owned Enterprise) is now eligible for an ICP (Internet Content Provider) license. Previously, only domestic companies or joint ventures with at least 51 percent of shares held by Chinese nationals could obtain an ICP license. But whether a company should obtain an ICP license can vary depending on location. It is recommended that foreign investors confirm with their local MIIT (the Ministry of Industry and Information Technology) during the pre-investment stage.
